By signing the contract, voucher or application form, the traveler undertakes to fully accept these travel reservation conditions. These General Terms and Conditions are an integral part of the Agreement (voucher or offer) for accommodation services in hotels or private accommodation concluded between the agency Annalinea d.o.o. and the travel contractor (hereinafter referred to as the passenger). These conditions refer to organized transport and travel organized by Annalinea d.o.o. for which the agency charges for the service, and do not apply to passengers/or tourists who only use the mediation service for accommodation in rooms and apartments in Croatia.
The price of the service includes the basic service (rent), which is described with the type of accommodation capacity from the reservation. Additional services are all those services that are not included in the price of accommodation and are paid separately by the passenger. Additional services must be requested when booking. Inquiries and accommodation reservations are accepted exclusively in writing. The accommodation reservation is considered completed only upon receipt of payment according to the proforma invoice or if otherwise agreed upon in the reservation confirmation.
Annalinea d.o.o. may request an increase in the agreed price if, after the day of signing the contract, there has been: a change in currency exchange rates compared to the day the program was published, a change in transportation costs (fuel, tolls, etc.), a change in carrier and hotelier tariffs. Annalinea d.o.o. may inform the passenger of price changes in writing (by post, fax or e-mail). To travelers who have made a payment according to the invoice for a specific reservation, Annalinea d.o.o. guarantees the accommodation price, and if the change occurs before the advance payment, Annalinea d.o.o. undertakes to inform the passenger about the price change. The passenger can cancel the trip without cancellation costs if there is an increase in the price of more than 10% compared to the agreed price, within 48 hours of receiving the written notification at the latest. If the passenger does not terminate the contract in person by coming to the agency Annalinea d.o.o. or in writing within the specified period, it is considered that he agrees with the price change. The published prices are the result of the Annaline d.o.o. contract. with partners and do not have to correspond to the prices displayed on the spot in the destination where the traveler is staying.
Travel documentation consists of receipts of payment or vouchers (if the service is paid in full before the guest's arrival). All travel documents will be delivered to the passenger no later than 7 days before departure.
The accommodation facilities offered are described according to the official categorization of the country in question, valid at the time the program is issued. Food, quality of accommodation as well as other services offered by hotels/apartments are under the supervision of local tourist authorities, and the standards of accommodation and services are different and not comparable. Annalinea d.o.o. assumes no responsibility for oral or written information that is not in accordance with the description. Tourist accommodation related to private accommodation: the apartments are furnished according to the owner's taste. Annalinea d.o.o. does not assume responsibility in case of incorrect information provided by the owner of accommodation capacities regarding the description of services and facilities in the published programs.
Related to tourists who book accommodation through the travel agency Annaline and pay through the agency. The layout of the room/apartment is determined by the reception in the place of stay. If the traveler has not expressly agreed on a room/apartment with special features, he will accept any officially registered accommodation unit for rent in a particular facility described in the catalog and price list. Accommodation in a room/apartment is usually not possible before 2 p.m. on the day the service begins, and it is usually necessary to vacate the room/apartment by 10 a.m. on the day the service ends. Arrivals after 8 p.m. must be announced in advance, unless otherwise indicated. Pets are not allowed. The number of available beds in the apartment also determines the maximum possible number of guests in the apartment, i.e. the apartment cannot be reserved for a larger number of guests than the number of beds in it. In that case, the child is counted as an adult. If more people arrive in the reserved accommodation unit than indicated on the travel documents (voucher or reservation confirmation), the service provider has the right to refuse service to unregistered passengers or to accept all passengers at a surcharge on the spot. In the event that accommodation in the apartment is canceled only by individual persons, it is not possible to return or reduce the rental price, since the price published in the price list refers to the entire apartment.
If the passenger cancels the arrangement, Annalinea d.o.o. from the total price of the arrangement, he keeps: • up to 30 days before departure 10% of the arrangement price • 29 to 22 days before departure 25% of the arrangement price • 21 to 15 days before departure 40% of the arrangement price • 14 to 8 days before departure 80% of the arrangement price • 7 - 0 days before departure 100% of the price of the arrangement. The mentioned cancellation costs also apply to changes in the date of departure or the accommodation facility, i.e. the type of room/apartment, as well as to all other important changes. If a traveler who cancels a trip finds a new user of the same reservation, who meets all the conditions of Annaline d.o.o. charges only the costs caused by the replacement. If the passenger has to cancel the reservation within 7 days before the start of the service, Annalinea d.o.o. offers the possibility to find a new passenger for the reserved accommodation (this also depends on the final service provider). The new traveler assumes all obligations from these General Terms and Conditions. If the passenger does not arrive at the reserved accommodation on the day the service starts, without notifying the Annalinea d.o.o. agency beforehand, the reservation is considered cancelled.
Annalinea d.o.o. reserves the right to change the reservation, if extraordinary circumstances occur that cannot be foreseen. Annalinea d.o.o. can replace the reserved accommodation only with prior notification to the passenger and that with accommodation of the same or higher category at the price at which the passenger confirmed the reservation. In the event of the impossibility of replacing the paid accommodation, Annalinea d.o.o. reserves the right to cancel the reservation with prior written notice to the passenger, at least 7 days before the start of using the service, with a refund of the amount paid. The passenger in case of cancellation of the reservation by Annaline d.o.o. has no right to claim damages. If not enough passengers register, Annalinea d.o.o. reserves the right to cancel the reservation, but no later than 3 days before the start of the trip. The minimum number of passengers required for each trip is indicated separately for each program/arrangement. Annalinea d.o.o. reserves the right to change the day or time of departure due to changes in the flight schedule or the occurrence of unforeseen circumstances, as well as the right to change the direction of travel if the travel conditions change, such as some of them: changed flight schedule, security situation in the country, weather (un)opportunities and without payment of compensation, and according to the current regulations in international traffic. If Annalinea d.o.o. cancels the trip, the passenger has the right to payment of the paid amount in full.
Passengers are required to have valid personal travel documents. Invalid documents, which result in cancellation of the trip, do not cause any adverse consequences for Annalinea d.o.o. If, due to such an omission, the passengers of Annaline d.o.o. suffered additional damage, the passenger is obliged to compensate for the same. If travel documents are lost or stolen during the trip, the cost of issuing new documents is borne by the traveler.
Passengers are obliged to comply with foreign exchange and customs regulations, as well as laws and other by-laws of the Republic of Croatia and other countries they pass through and in which they stay. Annalinea d.o.o. is not responsible for the decisions of customs, police and other government bodies that do not allow the traveler to enter a particular country. In the case of the impossibility of continuing the trip due to violation of the regulations by the passenger, all incurred costs are borne by the violator.
We emphasize that it is in the interest of the passenger to try to solve his complaint immediately with the service provider on the spot, who will try to provide the contracted service, i.e. correct errors. If there is no improvement even after a complaint, the passenger must ask for a certificate showing that the service was not provided, or that it was not provided in the manner agreed upon. The passenger must attach the confirmation to the written complaint. The passenger is obliged to submit a written complaint within 8 days after the end of the trip. If the passenger submits a written complaint after that deadline, Annalinea d.o.o. is not obliged to take such complaint into account. In order to resolve a complaint about services abroad, it is mandatory to follow the rule of filing a complaint with the issuance of a certificate on the spot and the deadline for submitting a complaint. The organizer is obliged to issue a written solution to this complaint within 14 days of receiving the complaint, and may postpone the deadline for a decision on the complaint for an additional 14 days due to the collection of information. The organizer will resolve only those complaints that could not be resolved at the vacation spot. While the resolution process lasts, and in total no more than 14, or 28 days after lodging the complaint, the traveler irrevocably renounces mediation by any other person as well as providing information to the media. Likewise, during this time, the passenger waives the right to sue. The maximum amount of compensation per complaint can reach the amount of the advertised part of the services, and it cannot include the already used services as well as the entire amount of the arrangement. Putnik and Annalinea d.o.o. will try to resolve disputes amicably, otherwise they agree to the jurisdiction of the court in Opatija. The applicable law will be the law of the Republic of Croatia.
Annalinea d.o.o. is obliged to take care of the execution of services, as well as the choice of service providers, with the attention of a good businessman and take care of the rights and interests of travelers in accordance with good customs in tourism. Annalinea d.o.o. is obliged to provide the passenger with all contracted services for a particular arrangement and to provide answers for possible non-performance of services or part of services. Annalinea d.o.o. will carry out all the stated obligations from its programs in full and in the manner described, except in case of "force majeure" or changed circumstances. If possible, Annalinea d.o.o. will offer an alternative solution in such cases. Annalinea d.o.o. is not obliged to provide services outside of these Terms.
The traveler is obliged to ensure that he personally fulfills the requirements stipulated by the regulations of the Republic of Croatia and the country he is traveling through or to, as well as to comply with the house rules in hotels and other facilities and to cooperate with the organizer's representative and service providers. The passenger himself is responsible for the damage he causes, and especially for the damage that occurred as a result of non-compliance with the contract and these general conditions. The damage caused will be borne by the passenger immediately at the reception of the hotel, agency Annalinea d.o.o. and in another place determined by the natural or legal person to whom he caused damage.
In accordance with the Tourism Act, in case of insolvency or bankruptcy of Annaline d.o.o., passengers caught on the trip, as well as persons who have paid advance payments for the trip, should contact the insurer specified on the reservation confirmation or Contract or other appropriate document as soon as possible.
In accordance with the Act on providing services in tourism, Annalinea d.o.o. has concluded an insurance contract with the insurer for liability insurance for damage caused to the passenger by non-fulfillment, partial fulfillment or irregular fulfillment of obligations related to the trip.
The passenger provides personal data voluntarily. The passenger's personal data is necessary in the process of realizing the requested service. Annalinea d.o.o. undertakes not to take the passenger's personal data out of the country or give it to a third party, except for the purpose of realizing the requested service. The passenger's personal data will be stored in the database. The passenger gives his consent that his personal data can be used for the purpose of Annaline d.o.o.'s marketing campaigns.
These general travel conditions are an integral part of the contract that the traveler enters into with Annalinea d.o.o. Possible/anticipated deviations from these Terms and Conditions must be listed with the text of the travel program.
